"a. Actual losses, injuries, harm or detriment sustained. b. The monetary penalty assessed against a tortfeasor. Damages can be of the following types: Nominal Damages: A very small amount of money awarded to the plaintiff in order to vindicate, or support his rights with which the defendant has interfered. Compensatory Damages: The closest possible amount of money equivalent to the losses suffered by the injured plaintiff; used to restore the plaintiff to the financial position he was in before the tort was committed; Punitive Damages: An amount of money awarded to the injured plaintiff which exceeds Compensatory Damages; used to make an example out of the defendant's misconduct so others will not behave similarly, and to punish the defendant for so acting; sometimes referred to as Exemplary Damages or Vindictive Damages."
